It was discovered in early 2020 that third parties had been unlawfully accessing records for some 900,000 people, most of whom were customers of Virgin Media.<\/p>\n

The issue was identified as a database configuration problem, and Virgin Media were only alerted to the issue after the information had been left online for a period of 10 months. In our view, this was a clear breach of the GDPR which is why we are pursuing a group action for compensation. Third parties unlawfully accessing records for Virgin Media<\/strong><\/h3>\n

Unlawfully accessing records can amount to a breach of the GDPR on the part of the company whose records have been accessed, if there was more that they could – and should – have done to have prevented the incident from taking place.<\/p>\n

In the Virgin Media data leak that came to light in early 2020, it was discovered that third parties had been unlawfully accessing records of some 900,000 people as a result of a database configuration problem. One of those who accessed the information was a third-party security researcher who alerted Virgin Media to the problem, but there was also another unknown access event by a third party as well.<\/p>\n

There should never be cases of third parties unlawfully accessing records because the duty that an organisation has to protect the information in their charge is clear in law. As we said above, if there was more that should have been done then this could constitute a breach of the GDPR which means that any victims affected could be entitled to claim compensation.<\/strong><\/a><\/p>\n

We are firm in our view that Virgin Media has breached the GDPR as a result of the database being left online for a period of 10 months due to the configuration error.
