Virgin Media data incident: advice for victims

Virgin Media data incident

If you have been affected by the Virgin Media data incident, what can you do about it and how can we help you?

We’re representing a huge number of people for No Win, No Fee legal cases, and we may be able to help you too. Any fine from the Information Commissioner’s Office (ICO) isn’t designed to be used as compensation for victims, and money from penalties usually ends up in the public purse. For the victims to receive justice for what has happened, a separate legal case needs to be made and we’ve launched a group compensation action for people to come together.

There’s strength in numbers. With our unique expertise in this complex and niche area of law, we may be able to represent you for a case on a No Win, No Fee basis.

Were you affected by the Virgin Media data incident?

If you’re one of the 900,000 victims of the Virgin Media data incident, you should have received notification from the company to confirm that your data has been exposed. Information had been left unsure and was accessible online for a period of 10 months between April 2019 and February 2020.

Once the exposed data was discovered by a third-party security researcher who informed Virgin Media, the issue was resolved. Unfortunately, during the prolonged breach period, at least one other unknown third-party accessed the exposed information. It remains unknown as to who they are and what, if anything, they have done with the data, or perhaps intend to do with it. We know that hackers and criminals use the same methods that security researchers do for finding exposed data, so it may be the case that the leaked information is now in the hands of criminals.

We just don’t know.

Over 1,000 of those whose information was exposed also had data leaked that related to contract information. Some of this is understood to have involved linking customers to explicit websites and gambling websites. For those individuals, the risk of being targeted may be greater.

What can you do as a victim?

If you’re a victim of the Virgin Media data incident, you have the legal right to make a claim for compensation. The GDPR can entitle to you receive damages for any distress caused by the loss of control of your personal information. Generally speaking, the more distressed you are, the more a case could be worth, and we can look to account for this for anyone who has had sensitive contract data exposed as well.

We’re already representing a large number of victims for the breach and we’re still taking cases forward now on a No Win, No Fee basis now. As long as you’ve received confirmation that you were affected by the breach, you should be eligible to join the compensation action that we have launched.

As a leading firm of consumer action and data breach compensation specialists, it’s our job – and our mission – to give a voice to the victims. Our lawyers and legal team are hard fighting for justice in over 50 different actions, and our firm has received High Court appointments to Steering Committees for some of the biggest and most ground-breaking litigations the UK has ever seen. For you, as a victim of the breach, this is absolute assurance that we can, and will, do all we can to fight for your rights to justice.
